ReplyDeleteThat was a weird decision. Funny. The liberals on the court voted in favor of it.
Yeah, it was really bizarre. Your normal big business conservatives: Thomas, Scalia, etc. were dissenters.
ReplyDeleteIt's just one of those bad decisions that goes beyond politics. Hopefully, companies that try to push through with imminent domain will see the publicity nightmare of doing so.
Here's a great article that I had read in my Mother Jones a few months ago that goes into some specific stories of imminent domain: The condemned: in Ohio, and across the country, homeowners are battling cities and developers conspiring to seize their property
This is really not the disaster it seems. What the court said was that the states have the right to regulate the use and conditions of eminant domain. About half the states retrict eminant domain by law to public works, and my state (IN) is pushing through legislation to do just that. I'm sure most others will follow suit.
